Trial of three moneylenders accused of defrauding an elderly woman with dementia

This week is celebrated in the third section of the Court of Alicante trial against two men and a woman who are accused of cheating an elderly woman with dementia to appropriate their heritage in Dénia.

It was in January of 2008 when one of them granted the old woman a loan of 38.798 euros that was accompanied by an 29% interest on annual delay, which amounted to other 33.754 euros, to which it was necessary to add 13.579 euros expenses. The return of said credit was guaranteed with a mortgage on a farm in Dénia, property of the injured party, "who didn't know what he signed", according to the prosecution.

Subsequently, the same lender, NADR, acted as an intermediary for another company to grant the old woman two 156.017 euros loans in exchange for two mortgages on the already encumbered farm and another of her property, although she did not receive the money. For the public prosecutor, "The defendants were fully aware that the woman did not understand the terms of the contract".

Since the prosecution argue that the defendants took advantage of the victim's illness "that nullified or diminished in a very considerable way his cognitive and volitional abilities, as well as his low cultural level".
