Labor Inspection proposes to sanction Marina Salud for lack of communication to workers

The report issued by the Labor Inspectorate made to Marina Salud, in response to the complaint from the Company Committee, for the sale of shares, indicates that a serious fault was incurred by not informing the workers' representatives and the union delegates.

From the Company Committee, through a statement, they have explained that the only information they received about the sale of shares between the two partners of Marina Salud SA, becoming a sole proprietorship company where 100% of the shares are of Ribera Salud SA, was on August 24, at 22:08 p.m., with "a brief communication from Management addressed to the workers by email".

Given this fact, the Works Council, as indicated in the document, requested the President of the Generalitat, Ximo Puig and to the Ministry of Health and the Ministry of Transparency, to stop and prevent the share sale operation between DKV and Ribera Salud, for the following reasons:

  • Failure to comply with article 64 of the Workers' Statute, as the Company Committee was not informed in advance and was unable to make a prior report.
  • With this commercial operation, the Health Law of CV 8/2018 of April 20, (preamble VI), is violated, which places limitations on the acquisition of share titles or participations of public entities, with the aim of protecting the user interests.
  • The need for prior and express authorization from the Ministry of Health, according to the legal report of the Generalitat Valenciana signed in May 2016.

Likewise, as indicated by the Company Committee, they also filed a complaint with the Alicante Labor Inspectorate for breach of the Workers' Statute by not informing and consulting the workers' representatives.

Given these two complaints, the Committee points out that the report of the Generalitat Valenciana Advocacy indicated that the express and prior authorization of the administration is needed for the sale of the shares, "an issue that was not fulfilled"; and the labor inspection report states that "the company MARINA SALUD SA has violated the rights to information, hearing and consultation of the workers' representatives and union delegates. This breach is classified as a SERIOUS infraction in labor matters by which issues the corresponding act of infraction".

The Works Committee has shown its satisfaction with the support obtained by the Labor Inspection and the Lawyers of the Generalitat, and urges the Minister Ana Barceló, "to start without further delay the process of reverting to the public sector of the Department of Health of Denia, without having to wait for the concession to end in January 2024".

This medium has asked the Marina Salud company about this fact and has replied that "it regrets not being able to make an assessment given that it has not received any type of communication from the Labor Inspectorate to date".
