Dénia will demand from the Generalitat the refund of fees for incorrect payment of some terraces

01 December 2023 - 09: 36

The plenary session of the Dénia City Council has approved requesting from the General Directorate of Ports, Airports and Coasts the return of the amounts unduly collected as a fee for the exploitation as terraces of 1.790,62 square meters of land in the port public domain as terraces. The General Directorate of Ports authorized the city council to this exploitation, by resolution of May 13, 2020, in exchange for the payment of a fee.

But in a review of the conditions of the permit, it came to light that the scope of the authorization includes land that was part of State Heritage and that it has transferred free of charge to the Dénia City Council since April 2022. The surface area transferred by the State It is 4.015,66 square meters, of which 1.375,54 square meters, currently owned by the city council, can be exploited as terraces.

For this reason, it has been agreed to request the General Directorate of Ports to modify its authorization so that it faithfully collects the lands that are property of the Generalitat and leaves out those that are currently owned by the Dianense council, and that it returns the amounts unduly collected. for those 1.375,54 square meters of land that were not their property, but rather the State's.

This modification means that the scope of authorization of the Generalitat is reduced to 2.871,56 square meters (of the 6.887,22 square meters contemplated in the initial authorization of 2020), of which 415,08 square meters can be exploited as terraces (in front to the 1.790,62 square meters for which the city council paid).

This agreement has been adopted by majority with the favorable vote of PSPV, Compromís, Vox and Gent of Dénia and the abstention from Party.

The three points have been approved unanimously.
