APAD's proposal is annulled for "not wanting to render accounts"

The City Council of Dénia has decided to cancel the proposal of the protective APAD for contracting the collection of animals. It does so after the negative assessment of the technicians in which points were breached in a report "demolition Man".

The government team has called the media this morning to announce the decision. One of the points where APAD would not comply with the bidding contract, and of which the people in charge of the Town Hall have been most concerned, is about hiring workers. Apparently, the protector would disagree with regard to sharing with the Administration the payroll of its employees, among other issues. "We cannot consent that workers are not discharged and do not meet salaries or schedules", declares the councilman Paco Roselló, Ensuring that "on this subject they will be inflexible in this or any other contract".

According to the City Council, in order to comply with the contractual obligations of the workers, APAD have requested triple the budgeted amount, 137.000 € for the 2 years of agreement, to, among other things, pay the extras at night for the workers. Lack of transparency

The issue of contracts with workers is only one of the different points that APAD would fail to continue with the tender. Animal disposal

One of the great concerns of dianenses has undoubtedly been the possible hiring of a company that favored the slaughter of animals. Scotto has ensured that such possibility is legally contemplated but as a last resort, after going through many processes, among which is, for example, declaring the animal as unfit for adoption and that no other center could take care of it. This would ensure that the case of a sacrifice did not occur, like all these years in which the decision has only been made in the case of diseases.

"We value your voluntary function", declares Scotto about APAD, "But you must ensure good management for these types of concessions". Therefore, so far the tender has been suspended. Now, the City Council will work to review the specifications and will take it out again in the coming months.

    DEADLY DECEPTIONED APAD ...

    The 7 of December of 2018, the registration was closed to participate in the bidding contest to manage the COLLECTION SERVICE, RETAINING OF ABANDONED ANIMALS AND MANAGEMENT OF DENIA ADOPTIONS. After 9 months of controversy, waiting, drama and hope, APAD received the award proposal and the August 19 asked us for the additional documentation required in clause 4 of the Administrative Terms and Conditions and deposit of the final guarantee of € 6.867,16 . APAD delivered all requested documents on time on August 30 2019.

    But on September 12 of 2019 we received a very disappointing surprise. We receive notification that 'APAD does not meet the requirements' and that a new tender is published. The decision has nothing to do with the presentation of documentation of the last phase. It is totally incomprehensible but the notification says that APAD does not meet the requirements that had already been submitted and scored in the 2 phase of the tender having received 37 points for the execution of the services, 15 points more than Serproanimal, and having exceeded both this phase of the contest. Furthermore, at no time since the award proposal have we been informed of a breach or requested additional information regarding the requirements for non-compliance. Worse, they asked us to present the documents of the last phase of the tender, with the consequent implication of the disbursement of a very important economic amount for our entity, as is the case of having to sign a bank guarantee in the form of a guarantee. of 6.867,16 €. APAD is deeply disappointed that these things can happen.

    The "summary" specified in the notification is incorrect and out of context.

    This is the third tender for the same service. The first tender, July 2018, was empty; No one showed up for not having had information about the publication. The second tender, August 2018, was also empty. No organization was presented, and APAD did not participate because the economic offer was very low and because the requirements of the specifications were very complex and difficult to meet for any organization or association. After the second tender, in September 2018 we had a meeting with the town hall and asked for a change in the specifications. Then the third tender came out in November 2018, this time with a change in the economic part but without the changes we ask for in complex and difficult compliance requirements. APAD decided to continue fighting for animals and decided to participate in the tender knowing that there were difficult compliance requirements. That is why APAD proposed in its proposal solutions on how these requirements could be fulfilled as well as possible.

    No, we cannot accommodate animals other than dogs, the town hall facilities where you must work only have dog accommodations. That is why we collaborate with other entities to host other species in suitable sites. We cannot accommodate cats, but we collaborate with Aldea Felina. We cannot accommodate horses, but we collaborate with APAC, etc. This was our proposal to the city council, to collaborate with other protectors to house species that are not dogs.

    No, we cannot pay a veterinarian to be on duty 24 hours of the day just for the collection of animals. And a veterinarian cannot work 24 hours a day. More veterinarians should be hired to be on duty 24 hours for the collection of animals. What veterinarian does this? What would it cost? That is why we proposed, as we are working at this time, to continue collaborating with NEXO, which has a veterinarian on duty at 24 hours.

    On the 24 hours pick-up service, such a service involves rotating shifts of drivers, an 24 driver cannot work hours a day, 7 days a week. And no, we cannot afford 3 drivers, but now we have 2 and pay with donations.

    And as for our willingness to share our administration with the town hall: WE HAVE BEEN YEARS ALL THE YEARS NOW, how many dogs have come in, how many dogs have been adopted, everything. We send it electronically, so we have PROOF that we send it. We also convened several meetings with the councilman in which we present all our numbers, operational and economic.

    In recent years we have NEVER failed to offer any service and have always found solutions for all the problems that were presented to us. And the way we work now (and it's the way we proposed in our response to 2 about the tender) seems to be worthless now.

    A brief summary of some facts carried out by APAD that do not seem to be valued in the decision:

    The APN expenses of 2016-2018 were € 170.000 average per year of which almost half are veterinary expenses and we only received a grant of € 24.744 per year from the town hall. The APAD difference has been collected thanks to its donors, partners and volunteers, adopters, supporters and the board's own money.
    In the last 3 years we have collected an average of 780 animals a year from the street,
    In the last 3 years APAD has achieved adoptions for an average of 205 dogs per year and every year about 50% of these dogs were adopted abroad thanks to the collaborations there that APAD has established.
    APAD practices zero sacrifice and considers all adoptable animals.
    APAD has found for the other animal species that it could not host a suitable place where they are well cared for such as cats in Aldea Felina
    APAD is considered one of the cleanest and most hygienic associations in the entire Valencian Community
    No sick or injured dog is left without treatment. APAD treats all its animals until they recover.
    In the last 3 years APAD castrated an average of 140 dogs a year and put an average of 160 microchips a year.
    We employ 8 people from Denia
    The work of the board of directors of APAD is done without remuneration.
    APAD has a team of volunteers with an economic value of at least 12 workers who without reward in their free time carry out their work for the love of animals
    APAD has the zoo core license and every year we have two inspections by the Department and the City Council to assess whether APAD has everything in order and if it meets the standards. We always get positive inspection records.

    In short, what happened? APAD presented in its response to the 2 Envelope of the tender that it could not do things exactly as described in the specifications but that it had solutions and alternatives to do so. And after all at the end of the bidding process, it seems that these solutions and alternatives already proposed in the 2 phase of the tender, and this is how we work now, do not seem suitable for the city council.

    And what is even more incomprehensible is that APAD had already passed the 2 phase of the tender with more points than the other participant, and our response was valued and accepted, so we received the award proposal when the other participant withdrew.

    Although our lawyer says that we have reason to appeal this decision, we doubt whether we want to do so. A relationship has to come from two sides.

    This has been the third tender without resolution. We are waiting for almost a new contract for 2 years and we continue to provide the service without complaining, receiving a very low subsidy and with very high expenses. The very complicated requirements of the current APAD specifications can never be met. Then, without changing the requirements of the APAD specifications you can never get the contract for the Denia collection service. We doubt if another organization can accomplish everything.

    APAD has lost hope, will this be the time for APAD to think of other ways to help animals?
