After the presentation of the plan of the Provincial Council of Alicante and its infrastructure area on Friday March 6, 2020 in Xixona, anticipating the content of the plan, and the distribution corresponding to municipalities and Minor Local Entities, Jesús Pobre was penalized in 50 % from the investment. That is, its reduction in 240.000 euros compared to the 456.000 euros initially estimated, so the Neighborhood Board, after a meeting held by all its members, made a legal consultation, formulating on March 11, 2020 by entry registration, brief of allegations.
In the aforementioned allegations made before the infrastructure area, the Eatim de Jesús Pobre exposes the nominal investment of 2018 assimilable to the POS of said annuity, the resignation of the 2019 annuity, the resolutions and conditions expressly drafted by the Alicante Provincial Council, detailing in which conditions it was granted, as well as the express or tacit non-waiver of the investments of the period corresponding to the plan planned from 2021 to 2023 in any of the neighborhood agreements.
Of the steps taken by the mayor Javier Scotto, responsible for the investment area for the Local Minor Entity, it has been learned that the reduction is due to the double amount in the nominal investment, however this investment is not from 2019, but from a previous year, having already been penalized in the POS 2019, and in the condition approved and forwarded in its day by the Alicante Provincial Council for its plenary approval by Eatim, it was never recorded that it was greater than one annuity, nor was multi-year liquidation practiced as it has been done to entities premises benefited in 2019, when any resignation requires that it be expressly informed and communicated.
The Neighborhood Board shows that this accumulation of contradictions and retroactive application of conditions is due to the continuous decisions and changes "on the fly" in the nominal investments of 2018, without thinking about the consequences that in the case of this entity Local Minor, represents for 4 years, an investment of only 240.000 euros, the smallest investment granted to Eatim in the last two legislatures, eight years, the biggest setback suffered with the infrastructure area of the Alicante Provincial Council.
To date, the allegations made have not received any response, however, and the conditions have been published in the BOP, and after a meeting held by the Neighborhood Board, the Eatim de Jesús Pobre waives the filing of an administrative contentious appeal against the aforementioned plan. , given that between the initial allegations on March 10, 2020 and its final approval, the health and economic crisis for the entire province has occurred, so that if the aforementioned appeal is formulated, the investment would be paralyzed, a situation that Eatim de Jesús Pobre has decided to avoid so as not to harm the province in these difficult times when the investment is necessary, despite having a legal consultation favorable to the viability of the challenge.
