The hell of revolving cards: a neighbor of Dénia recovers 10.824 euros after 6 years of debts

Alicante has become one of the Spanish provinces most punished by credit contracts and revolving cards. Popularized by allowing consumers to have certain amounts of money to be repaid in installments, the reality is that their remuneration interests and APR are very high.

However, in recent months there have been a significant number of judgments that concede reason to those affected, highlighting the bad practices of financial issuers.

One of the latest cases has taken place in Dénia, where the Court of First Instance Number 3 has issued an unfavorable ruling for the financial company Wizink that not only cancels the revolving contract conferred on a Dianense neighbor, but allows the same to recover about 11.000 euros, including 9.236 in interest and 1.598 in commissions.

The Recupera Revolving platform, specialized in consumer defense against banks and finance companies, maintained in its defense that the contract "did not exceed the control of incorporation, lack of transparency, imbalance and abusiveness", recurring elements, and pointed out the existence of "usurious nature of remunerative interest ”of the same, a point that the judge himself highlights in the issuance of his ruling.

The weight of the news increases when we learn that on March 25, just a few days after the ruling was handed down, the CJEU has ruled in favor of the doctrine of the Supreme Court, which based on the Azcárate Law of 1908 annuls those contracts for usury revolving that significantly exceed the average interest rate, located around 20%.

Thus, not only the Spanish justice is on the side of the consumers, but also the European one. As indicated by the platform consulted: "With this car the way is strengthened for those affected by this kind of credits and cards, a significant number in Alicante, to claim the justice and recover those abusive amounts that have been paying more, to sometimes for years, in the form of interest and commissions ”.

The forecast for the coming months is of a significant increase not only in claims but also in resolutions in favor of those affected from Alicante who, as in the aforementioned case, can sometimes take years of fighting against revolving card fraud.
