The Club Kitesurf Dénia studies sue the city council for not authorizing the School of Kitesurf

22 June 2018 - 07: 57

The Dénia Kitesurf Club that Luis Fernández presides over is studying the possibility of suing the Dénia City Council for not granting the pertinent authorization for the installation of the Kitesurf School in the area of the mouth of the Racons River, on the beach of Les Deveses.

Fernández acknowledges that he found out through the press in an interview conducted in the newspaper Las Provincias, with the councilor of beaches, Óscar Mengual of the prohibition to that installation, since a notification of Costas had been received in the town hall in which, by application of the Pativel Law, the installation of the school in that location was disallowed. According to Mengual, the city council was going to comply with this notification when coming from a superior administration.

The kitesurf school was to start the 1 in July. Your 9 monitors will go to stoppage, so will the security coordinator. This entails substantial losses for which the Club is going to demand compensation. Fernandez explains that, "he had bought a support boat and he will also lose all the investment in equipment and new material, kites, boards, etc. Yesterday we read that a kitesurf shop in Denia is in liquidation by closing. And it seems that this does not worry politicians. We assume that they would be more worried about not collecting their salaries or being fired for having done their job badly.".

Tender Kitesurf School

From the Club Kitesurf Dénia, explanations are requested to the Dianense consistory since a contracting table was created for the award of the kitesurfing school in that location. The deadline for opening the envelope on said award was that of abirl's 27, but it has not been opened so far.

Luis Fernandez finds it hard to believe that the 4 in May, just a week later, was approved by the Consell's Decree the famous Pativel Law for the protection of the coastline, which prohibits kitesurfing schools in the usual beach where it was planned and that the City Council brought to auction for 2018-2019.

From this club they ask themselves if in the City council it was not known that there was a Project of Law Pativel, whose approval and publication would prevent the school? Why did they miss the deadline and opened the envelope when he played? And more knowing that the only school had appeared at the auction was the Club Kitesurf Dénia. It was on purpose?. Were they aware of the damage caused? Questions that nobody has answered so far.

The Pativel Law does not apply retroactively, that is, it would have allowed the kitesurfing school during 2018 and 2019, if it had been awarded within the 27 of April, the maximum term that the City Council had. Fernández thinks that "They have done wrong and they know it. They have breached the Law of recruitment and the consequence of that act is that they have seriously damaged our club".

Installation of a channel for Kitesurf

This past Monday members of the Club Kitesurf Dénia, Óscar Mengual, councilor of beaches, and the mayor himself, Vicent GrimaltThey held a meeting. From the club, it is requested that the consistory appeal the resolution of Costas and that it allow the prudent installation of the school for this summer. They have promised that they will at least install a kitesurfing channel for free practice, at Les Deveses beach, in a permitted area next to the area where the school was to go.

Petition for change of this law

The club understands that the school of kitesurfing is not incompatible with the protection of the dunes, and yet if other uses are allowed, such as beach bars, inflatable castles, etc. Their sport is respectful with the environment, they are moved by the wind and waves, they do not pollute, they love nature and the beach.

Fernandez assumes that in the future the Law will be modified, since it affects many beaches of the Valencian Community. Town councils such as Oliva have already appeared in the Consellería to express their discomfort, since much of their tourism comes to these beaches to practice kitesurfing. On the beaches of Dénia and Oliva prestigious national and international championships are held. Many tourists who have bought or rented apartments to practice this sport have stated that they will stop coming to spend their holidays in Dénia.
