Dénia asks Justice to "urgently" improve the endowment of the judicial party to end the "more than evident" current shortcomings

November 26 from 2021 - 12: 59

The groups that make up the Municipal Corporation have unanimously approved this week in plenary session to urge the Department of Justice, Interior and Public Administration, as well as the Ministry of Justice that "urgently put the means to improve the provision of the Courts of the Judicial Party of Dénia, since the current deficiencies are more than evident ”.

The expository part of the motion argues with data that "the Judicial Party of Dénia is neither sized nor endowed with the means to meet the judicial needs of the region of the Marina Alta, at a clear disadvantage with respect to the other nearby judicial districts analyzed”. According to information from the General Council of the Judiciary, the judicial district of Dénia registers in 2020 178.203 inhabitants and 9 courts: 5 of First Instance, 3 of Instruction and 1 of Violence against women. The neighboring judicial district of Benidorm, to give an example, has 14 courts for a population of 120.153 inhabitants in 2020 (CGPJ data).

The text lists a series of deficiencies in the Judicial Party of Dénia that must be addressed to improve the current situation. Among them, it stands out that more than 40% of the criminal trials that are held in Benidorm come from the territory of Dénia, with the consequent disruption that such amount of displacements entail for citizens, police and professionals. It also recalls that Court No. 6 of First Instance is approved, but not in operation, "having to provide for the creation of No. 7 given the current circumstances." The itinerant court also approved has not been launched "due to lack of means" and the current number of two forensics is insufficient, since "given the volume of work, at least three are needed."

The deficiencies also extend to the lawyers on duty - three a day, two to assist detainees and another for victims of gender violence. As explained in the motion, "to provide a better service, given the number of detainees, one more lawyer would be necessary to assist detainees, that is, four in total."

Finally, if the number of courts in the Judicial Party of Dénia increased to 10, "it would have a higher status before the Administration, thus being able to opt for many more aid and subsidies".

Therefore, the second point of the agreement establishes to request the Ministry of Justice to urge the Ministry of Justice to create the necessary jurisdictional bodies to cover the needs of the Judicial Party of Dénia, specifically the Criminal Court, as well as the activation of the Court of First Instance Number Six, whose creation has already been approved, as well as the provision of number Seven.

The motion will be forwarded to the town councils of the other municipalities that are part of the Judicial Party of Dénia, so that, in turn, they make agreements on the same terms and thus reinforce the claim.
